SCOPE AND MODIFICATION OF THE AGREEMENT
You agree to the terms and conditions outlined in the Agreement with respect to your use of the Website. The Agreement constitutes the entire and only agreement between you and The Software with respect to your use of the Website and supersedes all prior or contemporaneous agreements, representations, warranties and/or understandings with respect to the Website. We may amend the Agreement from time to time in our sole discretion, without specific notice to you. The latest Agreement will be posted on the Website, and you should review the Agreement prior to using the Website. By your continued use of the Website and/or Services, you hereby agree to comply with all of the terms and conditions contained within the Agreement effective at that time. Therefore, you should regularly check this page for updates and/or changes.
VEREISTES
Die webwerf en dienste is slegs beskikbaar vir individue wat onder toepaslike wet in wetlike bindende kontrakte kan aangaan. As jy onder die ouderdom van agtien (18) is, het jy nie die reg om die webwerf en/of dienste te gebruik en/of toegang tot die webwerf en/of dienste nie.
BESKRYWING VAN DIE DIENSTE
Vendor Dienste
Deur die toepaslike aankoopbestelvorms te voltooi, kan u bepaalde produkte en/of dienste van die webwerf verkry of poog om dit te verkry. Die produkte en/of dienste wat op die webwerf vertoon word, mag beskrywings bevat wat direk deur vervaardigers of verspreiders van sulke items verskaf word. Die sagteware verteenwoordig nie of waarborg dat die beskrywings van sulke items akkuraat of volledig is nie. U verstaan en stem daarmee in dat die sagteware nie verantwoordelik of aanspreeklik is op enige wyse vir u onvermoë om produkte en/of dienste van die webwerf te verkry nie of vir enige geskil met die verkoper, verspreider en eindgebruikers van die produk. U verstaan en stem daarmee in dat die sagteware nie aanspreeklik teenoor u of enige derde party sal wees vir enige eis met betrekking tot enige van die produkte en/of dienste wat op die webwerf aangebied word.
WEDSTRYDE
Van tyd tot tyd bied TheSoftware promosionele pryse en ander toekennings via Wedstryde aan. Deur ware en akkurate inligting in verband met die betrokke Wedstrydregistrasievorm te voorsien, en deur in te stem met die Amptelike Wedstrydreëls wat van toepassing is op elke Wedstryd, kan jy ‘n kans maak om die promosionele pryse wat deur elke Wedstryd aangebied word, te wen. Om aan die Wedstryde wat op die webwerf aangebied word, deel te neem, moet jy eers die toepaslike inskrywingsvorm volledig voltooi. Jy stem daarmee in om ware, akkurate, huidige en volledige Wedstrydregistrasiedata te voorsien. TheSoftware het die reg om enige Wedstrydregistrasiedata af te keur waar daar, in die uitsluitlike en uitsluitlike diskresie van TheSoftware, bepaal is dat: (i) jy in stryd is met enige gedeelte van die Ooreenkoms; en/of (ii) die Wedstrydregistrasiedata wat jy voorsien het, onvolledig, bedrieglik, ‘n duplikaat of andersins onaanvaarbaar is. TheSoftware mag te eniger tyd, na sy uitsluitlike diskresie, die Registrasiedata-kriteria verander.
LISENSIE TOEKENNING
As ‘n gebruiker van die webwerf, word ‘n nie-eksklusiewe, nie-oordraagbare, herroeplike en beperkte lisensie verleen om toegang te verkry en die webwerf, inhoud en geassosieerde materiale te gebruik in ooreenstemming met die ooreenkoms. Die sagteware kan hierdie lisensie te eniger tyd om enige rede beëindig. Jy mag die webwerf en inhoud op een rekenaar vir jou eie persoonlike, nie-kommersiële gebruik gebruik. Geen deel van die webwerf, inhoud, wedstryde en/of dienste mag in enige vorm gereproduseer word of ingesluit word in enige inligtingsophaalstelsel, elektronies of meganies. Jy mag nie die webwerf, inhoud, wedstryde en/of dienste of enige gedeelte daarvan gebruik, kopieer, nadoen, kloon, verhuur, verhuur, verkoop, wysig, dekompiluleer, ontmantel, omgekeerde ingenieurswese of oordra nie. Die sagteware behou enige regte wat nie uitdruklik in die ooreenkoms verleen word nie. Jy mag geen toestel, sagteware of roetine gebruik om te interfereer of te probeer om te interfereer met die behoorlike werking van die webwerf nie. Jy mag geen aksie neem wat ‘n onredelike of oneweredige groot las op die infrastruktuur van die sagteware plaas nie. Jou reg om die webwerf, inhoud, wedstryde en/of dienste te gebruik, is nie oordraagbaar nie.
PROPRIETARY RIGHTS
The content, organization, graphics, design, compilation, magnetic translation, digital conversion, software, services and other matters related to the Website, Content, Contests and Services are protected under applicable copyrights, trademarks and other proprietary (including, but not limited to, intellectual property) rights. The copying, redistribution, publication or sale by you of any part of the Website, Content, Contests and/or Services is strictly prohibited. Systematic retrieval of material from the Website, Content, Contests and/or Services by automated means or any other form of scraping or data extraction in order to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from TheSoftware is prohibited. You do not acquire ownership rights to any content, document, software, services or other materials viewed at or through the Website, Content, Contests and/or Services. The posting of information or material on the Website, or by and through the Services, by TheSoftware does not constitute a waiver of any right in or to such information and/or materials. The TheSoftware name and logo, and all associated graphics, icons and service names, are trademarks of TheSoftware. All other trademarks appearing on the Website or by and through the Services are the property of their respective owners. The use of any trademark without the applicable owner’s express written consent is strictly prohibited.
HYPERLINKING TO THE WEBSITE, CO-BRANDING, “)FRAMING(“) AND/OR REFERENCING THE WEBSITE PROHIBITED
Unless expressly authorized by TheSoftware, no one may hyperlink the Website, or portions thereof (including, but not limited to, logotypes, trademarks, branding or copyrighted material), to their website or web venue for any reason. Further, “)framing(” the Website and/or referencing the Uniform Resource Locator (“)URL(“) of the Website in any commercial or non-commercial media without the prior, express, written permission of TheSoftware is strictly prohibited. You specifically agree to cooperate with the Website to remove or cease, as applicable, any such content or activity. You hereby acknowledge that you shall be liable for any and all damages associated therewith.
VERANDERING, VERWYDERING EN WIJZIGING
Ons behou die reg in ons uitsluitlike oordeel om enige dokumente, inligting of ander inhoud wat op die webwerf verskyn, te wysig en/of te verwyder.
DISCLAIMER FOR HARM CAUSED BY DOWNLOADS

INDEMNIFICATION
U agree to indemnify and hold TheSoftware, each of their parents, subsidiaries and affiliates, and each of their respective members, officers, directors, employees, agents, co-branders and/or other partners, harmless from and against any and all claims, expenses (including reasonable attorneys’ fees), damages, suits, costs, demands and/or judgments whatsoever, made by any third party due to or arising out of: (a) your use of the Website, Services, Content and/or entry into any Contest; (b) your breach of the Agreement; and/or (c) your violation of any rights of another individual and/or entity. The provisions of this paragraph are for the benefit of TheSoftware, each of their parents, subsidiaries and/or affiliates, and each of their respective officers, directors, members, employees, agents, shareholders, licensors, suppliers and/or attorneys. Each of these individuals and entities shall have the right to assert and enforce these provisions directly against you on its own behalf.
DERDE PARTY WEBWERWE

Verder ondersteun TheSoftware nie, en is nie verantwoordelik vir, enige voorwaardes, privaatheid beleid, inhoud, advertensies, dienste, produkte en/of ander materiale by of beskikbaar vanaf sulke derde party webwerwe of bronne, of vir enige skade en/of verliese wat daaruit voortspruit nie.
